MOTOR RENTAL AGREEMENT AND INVOICE
RETURN OF THE HIRE VEHICLE:- At the time and date of the finish of your vehicle hire your hire vehicle must be returned to A1 and 1A Car Hire Depots, Manor Gardens, Rear of 90 Union Street, Plymouth, PL1 3EZ.
DIRECTIONS to A1 Car Hire and 1A Car Hire depots:- From Derry's Cross roundabout in city centre, go down Union Street, straight ahead through traffic lights (passing Toys R' Us on right). At next roundabout (Octagon) turn right into Octagon St.. At next roundabout (mini) turn left into King St.. At next roundabout turn left into Manor Street. Go through "Home Zone" bollards, then left into Manor Gardens which is the very last alleyway that you can before the road ends. A1 and 1A Car Hire Depots are at the second garage on the right, approximately 50 yards down Manor gardens.
IN THE EVENT OF AN ACCIDENT DO NOT ADMIT LIABILITY. Complete the Accident Report Form, and take the following details from other person/s involved.
(1) Full name/s and address/es and telephone number/s.
(2) Registration number/s, and make/s and model/s of other vehicle/s.
(3) If any injuries or perceived driver/s fault inform police.
(4) Report accident to us immediately.
BREAKDOWN COVER In the event of a breakdown, please telephone 01752 668899 or 07743 668081 (24 hour service). Please note that any breakdown caused by driver fault or negligence, including running out of fuel, entering wrong fuel into vehicle, tyre & wheel damage, loss of keys, must be paid for by Hirer.
TERMS AND CONDITIONS OF HIRE
1. The hire vehicle shall not be used operated or driven (a) For the use of hire or reward. (b) By a person who is under 21 years of age or over 70 years of age (unless such approval has been given and agreed in writing). (c) By a person who has given to the Lessor any false or fictitious particulars. (d) Knowingly for any unlawful purpose. (d) To propel any other vehicle or trailer. (e) For racing, pacemaking, testing, or driving instruction. (f) By persons other than persons included in this agreement. (g) A motor repairer other than in the case of accident or breakdown. (g) To carry a greater amount of passengers or baggage or loading than recommended by the manufacturer. (h) Outside the area of England, Wales, or Scotland, except with the express written approval and authorisation of the Lessor. 2. The Hirer aged over 25 years of age agrees to pay an isurance excess for any loss or damage whatsoever caused to the vehicle and it's contents during the hire period up to a maximum of FIVE HUNDRED POUNDS. The Hirer aged under 25 years of age will pay for this damage up to a maximum of ONE THOUSAND POUNDS. These excesses will be dramatically reduced should our Collision Damage Waiver have been paid by the hirer.
3. The Hirer shall not use the vehicle if any fault or damage arises so as to make the vehicle unroadworthy, or liable to cause danger to any person or property.
4. The Lessor shall not be liable for any loss or damage to the Hirer's or other person's belongings, during, or before, or after the hire period. The Hirer will be responsible for all risk of such loss or damage and defend and indemnify the Lessor, and hold the Lessor harmless for all claims arising for such loss or damage.
5. The Hirer will be responsible for theft of vehicle should all keys not be removed from vehicle, and in possession of the Hirer, when vehicle is left unattended.
6. The Hirer having exclusive possession and control of the vehicle, has the responsibility and liability to the public and any regulatory body having jurisdiction.
7. The Hirer agrees to maintain the vehicle to a good standard particularly in respect of OIL, AND WATER LEVELS, TYRE PRESSURES.
8. In the event of accident of breakdown, damage or theft, the Hirer shall IMMEDIATELY inform the Lessor. Should the accident or breakdown be due to the Hirer's fault or negligence or unforeseen events, then the Hirer will be responsible for all repair and other costs, including food, telephone calls, taxi fares, et.c..
9. In the event of a hire vehicle, for whatsoever reason, being unavailable, or provided late, for the use of the Hirer, then the Lessor shall NOT be liable for any direct or indirect or consequential loss that the Hirer may suffer, including without limitation any loss of opportunity, profit, income, or reputation.
9A. In the event of an accident, howsoever caused, which renders the hire vehicle unfit for continuance of hire, then the hire agreement will be immediately terminated with no refund of any monies refundable to the Hirer.
10. The driver of the vehicle shall be the person who signs the agreement. The Hirer of the vehicle shall be the only person to drive unless a named additional driver or drivers are included in the Agreement, in which case the additional driver or drivers named may also drive the vehicle.
11. Loss or damage due to infringement of any motoring offence or driving negligence shall be the liability of the Hirer.
12. Full or part payment of the hire by a third party person renders that person fully and jointly responsible for any charges incurred by the Hirer.
13. Should the Hirer wish to prolong the hire period to after the finishing time and date of the Hire Agreement, then notice must be given to the Lessor 48 hours before this time and date, subject to vehicle availability, and new agreement/s for the extra hire time of hire be completed, and the extra time paid for.
14. In the event of the Hirer returning the vehicle more than ONE HALF HOUR LATER than the time and date of termination of this Agreement then the Hirer will forfeit the total of their deposit in full, plus any loss incurred due to non availability of the vehicle for another Hirer who has already booked hire for this agreed vehicle, plus compensation if required, plus additional days which will be deemed to be hired until the car is returned to the Lessor.
14A. Regretfully, failure to adhere to clauses 13 & 14 without notification to us will result A1 Car Hire reporting the vehicle to the police as stolen as a criminal act. 15. The Hirer must return the vehicle with at least the same amount of fuel as was in the vehicle at the start of hire. Should the vehicle not be returned accordingly then payment must be made to the Lessor as stated on the hire agreement or car damage sheet. NO REFUND OF EXTRA FUEL IN VEHICLE.
15A. The Hire vehicle must be returned in the same condition as at the start of hire period. Charges are made for heavily soiled, or damaged vehicles.
15B. No animals or birds are allowed in cars. Should this agreement be breached, then the Lessor will charge a fee to the Hirer the Lessor deems appropriate. 16. Unlimited mileage is available for hire of over 2 days. A hire of less than 3 days incurs a mileage charge of 8p per mile for every mile over 150 miles per day. 17. During the period of hire, and all unauthorised periods of use, the Hirer will be responsible for all traffic and parking violations. Fines, Charges, Wheel Clamping, Impounding by Customs and Excise, Police, and other authorised persons are the responsibility of the Hirer.
18. Should, for whatever reason, the Hirer not retain possession of the vehicle keys, their replacement must be paid for by the Hirer. In addition, a call out charge of £20.00 per hour, or any part of an hour, must be paid to the Lessor if replacement keys need to be delivered to the Hirer.
19. If any unauthorised person drives the hire vehicle then the agreement and insurance provided by the Lessor will be invalidated with no monies refundable.
20. Any damage to wheels, tyres, and radio aerials, is the responsibility of the Hirer and must be paid for by the Hirer.
21 Wrong fuel put into the hire vehicle during hire is deemed as negligence by the the Hirer, and repairs resulting from this action must be paid for by the Hirer. 22. At the finish of hire as stated on the Agreement, the hire vehicle must be returned to the address stated above under the heading RETURN OF THE HIRE VEHICLE, and, if it is not so returned, then the vehicle shall be deemed to be stolen by the Hirer.
23. Ownership of all property left in the hire vehicle and not claimed within two days after the return of the hire vehicle will pass to the Lessor who will be entitled to sell or dispose of the same for his own benefit as the Lessor so chooses.
24. Hirers aged under 25 or over 70, & hirers with more than one speeding conviction may incur additional charges. Hirers with certain high risk convictions, certain disabilities, and in certain occupational areas, may be prevented from hiring from us due to restrictions imposed by our insurers. Please contact us for clarification.
25. The Hirer will pay the Lessor on demand any charges as any clause or clauses above stipulate.
26. Both the Hirer and Lessor agree to these above terms and conditions..
